Jane Kirkby analyses the reform of the Court of Auditors
Jane Kirkby, a partner in Antas da Cunha Ecija's Public Law, Urban Planning, Environment and Energy Practice Area, takes part in the article "The tug-of-war over control of state spending", published by Observador.
In the article, the lawyer analyses the government's proposal to reform the organic law of the Court of Auditors, which envisages raising the threshold for prior approval to 10 million euros.
Jane Kirkby warns of the risk that this change will, in practice, significantly undermine the Court's preventive inspection powers, emphasising that in a small country, contracts above this value are relatively scarce. He also questions the comparison with other European countries, where the economic and institutional context is substantially different, with better prepared services and more qualified teams in the contracting authorities.
