Latest interpretations of the Constitutional Court in labour matters
ECIJA Ecuador' s Labour Law team has prepared a new briefing note analysing recent decisions of the Constitutional Court of Ecuador, whose criteria have a direct impact on the interpretation and application of labour rules by employers, workers and legal operators.
The publication addresses three issues of particular relevance. First, it reviews the parameters established by the Court for the identification and configuration of workplace harassment, as well as the elements that must be considered when assessing this type of conduct in the workplace.
Likewise, the note examines the criteria related to the reinforced labour protection during paternity leave, highlighting the scope of the constitutional guarantees recognised in favour of workers who exercise this right and the implications that these decisions can generate in labour relations.
Finally, the analysis includes the pronouncements concerning the termination of the special contract arising in situations of pregnancy, maternity and breastfeeding, specifying the considerations developed by the Constitutional Court regarding the protection of groups that enjoy special protection within the Ecuadorian legal system.
These decisions contribute to the development of constitutional jurisprudence in labour matters and constitute a relevant reference for human resources management, the adoption of internal policies and decision making in the corporate sphere.
