Reform of the domestic emergency leave scheme in the public sector is currently underway
Our Head of Employment Law, Francisco Dávalos, presents a new briefing note on the Draft Organic Reform Bill to guarantee equal access to leave following a family tragedy, applicable to the public sector.
Among the main proposed changes is the extension to eight days of leave following the death of a spouse, cohabiting partner, father, mother or child. The reform also proposes eight days’ leave in the event of serious illness or accident affecting a father or mother, and seeks to standardise leave following the death of other relatives up to the second degree of kinship or affinity at three days.
The article also analyses the differences with the private sector, whose current scheme provides for three days’ leave following the death of certain relatives, but does not provide for specific leave in the event of serious illness or accident affecting relatives, nor for serious incidents affecting the employee’s property. The draft bill under consideration does not amend the Labour Code.
