Enhanced employment protection for mothers and fathers during early childhood
Case No. 25,469
This bill strengthens the protection of workers during early childhood, promoting a comprehensive approach to shared family responsibility. Its central focus is to extend job security guarantees beyond pregnancy and breastfeeding, incorporating enhanced protection for both mothers and fathers of children under the age of two.
It proposes amending Article 94 of the Labour Code and introducing a new Article 94 ter to prohibit the dismissal of these workers unless there are justified grounds for serious misconduct, subject to prior authorisation from the National Directorate and General Labour Inspectorate.
Tax incentive: The bill also proposes allowing legal entities to deduct 10 per cent of the basic salary for each employee who is the mother or father of a child under the age of two, as a way of offsetting the costs associated with the enhanced protection.
