Artificial Intelligence Regulatory Map: where will Ecuador be?
In a global context where the regulation of Artificial Intelligence (AI) is becoming increasingly urgent, Sebastián Vallejo Constantine, senior associate in ECIJA GPA's LegalTech practice, offers an in-depth look at the approach being taken by Ecuador. His most recent article, published in LEXIS Ecuador under the title: "Regulatory Map of Artificial Intelligence: where will Ecuador stand?", poses a key question for the country's future in this area.
Vallejo identifies that Ecuador has opted for a strict Level 1 approach, aligned with the European model, which prioritises a rigid and preventive regulatory framework. While this decision aims to protect users and prevent risks, it could also pose significant challenges for the local innovation ecosystem by raising entry barriers for new technological ventures.
The article proposes that, given this reality, the creation of a National AI Strategy is urgent, in order to guarantee an informed, coherent and adapted regulatory development to the country's reality. Vallejo also compares the Ecuadorian approach with the other two major international models: the North American model, which is more flexible and oriented towards self-regulation, and the Asian model, which focuses on the development of state technological capacities.
