Reports2 July 2026
ECIJA Ecuador’s TMT department has published a new briefing note on the differences between gaming and gambling in Ecuador, based on Executive Decree No. 422, which sets out the regulatory framework applicable to both activities.

ECIJA Ecuador’s TMT (Technology, Media and Telecommunications), Privacy and Personal Data Protection practice has published a new briefing note on the regulatory framework applicable to gaming and gambling in Ecuador, based on the provisions set out in Executive Decree No. 422.

The analysis explains the main legal differences between the two activities. Whilst gaming encompasses e-sports and competitions based on skill and strategy, gambling refers to an economic activity linked to sports betting and wagers, subject to a specific licensing and supervisory regime.

The brief also addresses key aspects of the new regulatory framework, such as operators’ obligations, licensing requirements, responsible gaming measures, anti-money laundering mechanisms, the protection of minors, advertising rules and the consequences of non-compliance with current regulations.

Against a backdrop of growth in the digital economy and the entertainment industries, understanding the differences between these activities is essential for companies, developers, operators and investors operating in this market.

We invite you to read our briefing note to learn about the key regulatory aspects and the obligations set out in the new legal framework for gaming and gambling in Ecuador.
