Data Protection Strategy: A Sustainability Pillar for the Real Estate Sector

Articles14 January 2026
The protection of personal data as a strategic axis for the competitiveness, trust and sustainability of the real estate business in Chile.

In the last decade, digitalisation has transformed the architecture of the real estate and construction business in Chile, as business management has transcended the administration of physical assets, and the custody of personal data of clients, investors and suppliers has been consolidated as a high-value strategic asset and, simultaneously, as a critical responsibility.

Chile is going through a process of regulatory modernisation that aligns our data protection legislation with the standards of the European Union, which substantially raises the levels of requirements, introducing a regime of severe sanctions and the obligation to implement active risk management models, an environment in which information security is no longer a technical item, but an imperative of compliance and operational continuity.

The use of financial data, credit histories and investment preferences now makes it possible to segment markets and optimise the shopping experience. However, this intensive use requires robust governance protocols, as exposure to cyber-attacks or information leaks not only entails legal risks, but also represents a direct threat to corporate reputation and brand value, fundamental elements for sustaining market confidence.

Under a senior management vision, the implementation of a solid data protection system should be understood as an investment in competitiveness, so that organisations that lead this change through personal data protection policies, cybersecurity, internal audits and the appointment of data protection officers, will be able to reduce exposure to financial and legal risk, strengthen trust with investors and authorities, and differentiate themselves in the market by adopting higher quality standards.

In conclusion, the early adoption of privacy policies is an opportunity to lead the cultural change that the sector requires, and for real estate and construction companies, protecting data is to protect the future viability of the business, since in a regulated and highly digital environment, transparency in the management of information is the new foundation on which credibility and long-term profitability are built.

At ECIJA we can support you with the implementation for your company of the Infringement Prevention Manual contemplated in the new data protection law, which will come into force on 1 December 2026, and whose non-compliance entails hefty financial penalties.
