Environmental compliance: a strategic pillar for business continuity?

San José, Costa Rica - In a business context increasingly influenced by international standards, ESG criteria and stricter regulatory requirements, environmental legal compliance has become a determining factor for the continuity and sustainability of organisations.
"At the international level, regulatory changes and the adoption of global standards have significantly increased environmental obligations for companies, generating a direct impact on their suppliers and value chains. This phenomenon has been reinforced by the growing pressure from investors and financial institutions to integrate environmental, social and governance factors in their decision-making processes," said Marco Quesada, director of Environmental Law at ECIJA Costa Rica.
Large investment funds, such as BlackRock, have incorporated strategies aimed at promoting environmental and social features within their portfolios, with a particular emphasis on carbon footprint reduction and sustainability. Similarly, financial institutions such as BBVA have shown greater investor interest in identifying the sectors most sensitive to climate change, as well as in learning about the actions implemented to accompany their clients in the transition to a low-carbon economy. In addition to these factors, issues such as diversity, the pay gap, cybersecurity, data protection, business ethics and financial inclusion are all considered by ESG rating agencies.
One of the most relevant developments in this area has been the adoption of IFRS S1 and S2, which standardise sustainability-related disclosures in financial reporting. These provisions have permeated organisations of different sizes and industries, involving both parent companies and subsidiaries, and have prompted many countries to adapt their regulatory framework to align with these standards.
The complexity of environmental compliance in business operations
From practical experience, even companies with operations considered "small" can be subject to more than fifty environmental legal requirements, which increase as operational complexity increases. The presence of boilers, fuel tanks, wells, chemical warehouses or exposure to physical agents, among other factors, implies greater regulatory obligations. Likewise, compliance by suppliers, lessors or companies located in special regimes is critical, as non-compliance can directly affect business continuity.
In this scenario, environmental audits and compliance management systems become key tools, adding value by identifying applicable legal obligations, aligning with international standards and strengthening corporate governance, with the support of senior management.
Complying to protect business continuity
"Environmental compliance is not a bureaucratic formality, but a strategic component of business management. Ignoring these obligations can result in penalties, operational disruptions and loss of trust from stakeholders, including consumers, who today evaluate a brand's environmental management before making purchasing decisions," Quesada stressed.
He also emphasised that the constantly evolving regulatory framework requires proactive management by organisations. "Environmental regulations are constantly changing. Therefore, companies must have continuous monitoring and updating systems that allow them to anticipate risks and guarantee the sustainability of their operations in the long term," he added.
Failure to comply with environmental legal obligations can have significant impacts on business continuity. Against this backdrop, it is essential that organisations implement regular review processes, strengthen their compliance strategies and promote a corporate culture oriented towards environmental responsibility.
In an increasingly demanding environment, environmental legal compliance not only mitigates legal and operational risks, but also positions itself as a differentiating factor and a strategic investment for business sustainability and competitiveness.
