ECIJA advises Inetum and wins a 1.5 million euro contract after a special appeal in procurement matters

ECIJA reverses an award and secures for its client a 1.5 million euro public contract in the Canary Islands.

ECIJA has advised Inetum España in the filing of a special procurement appeal before the Administrative Court of Public Contracts of the Autonomous Community of the Canary Islands, in the framework of the procedure for the award of the contract for the technical office services for the deployment and support of Microsoft solutions for the Canary Islands Tax Agency.

Initially, Inetum was assessed as the tenderer which had submitted the best offer. However, following a special appeal lodged by the second-placed bidder, the contracting authority awarded the contract to the latter.

In a joint action between the company and ECIJA's Public and Regulatory Law department, a special appeal in public procurement matters was filed, pointing out a series of irregularities in the procedure that had to be remedied, which allowed the result of the tender to be reversed.

The same Canary Islands court has now upheld the appeal lodged by Inetum, annulling the initial award and ordering the exclusion of the successful tenderer's bid for failure to comply with the essential requirements of the tender specifications, in particular as regards solvency and subcontracting. The decision revokes the outcome of the tender procedure, awarding the contract to Inetum, with an estimated value of €1.5 million.

The procedure has been led by Jorge González Cortade, partner of the Public and Regulatory Law department, together with his team formed by Daniela Suescún Cadena, Ana Cañibano García and Irene Chillón Sorrentini.
