Condominium Law Update: Virtual Meetings Now Officially Allowed
For many expats living in Costa Rica, condo ownership is a popular choice, as it offers comfort, community, and convenience. But managing condo life also means staying up to date with local laws that affect how homeowners’ associations operate.
A new amendment to Costa Rica’s Condominium Law (Law No. 7933) came into effect on August 26, 2025. Guillermo E. Zúñiga, corporate law expert, will explain the new changes.
What Changed in the Condominium Law?
Articles 24 and 25 of the Condominium Law were updated to allow homeowners’ meetings to be held online using technological tools.
“This is a big step forward,” said Guillermo E. “Before, all meetings had to take place in person. Now, owners can participate from anywhere, whether you’re traveling or living abroad part of the year.”
The law allows for virtual meetings as long as they meet certain conditions, including:
- Real-time communication between participants
- Audio and video connection for everyone
- Interactive participation, not just one-way streaming
- Respect for principles of simultaneity, collegiality, and deliberation
“In short, everyone must be able to speak, listen, and vote just as they would in a traditional meeting,” he added.
How Virtual Meetings Will Work?
Condo meetings can be called by the administrator or by a group of owners representing at least one-third of the property’s total value.
“The key requirement,” Guillermo E. explained, “is that the meeting invite must clearly say it will be held virtually.”
The call should also include:
- How to log in and access the platform
- How to register to participate
- Any technical instructions for joining the meeting
“This ensures transparency and allows all owners, wherever they are, to take part in decision-making,” Guillermo E. noted.
Why This Matters for Expats
For expats who split time between Costa Rica and another country, this amendment is especially useful.
“It means you can still have a voice in your condos’ affairs, from board elections to maintenance approvals, even if you’re not physically here,” emphasized Guillermo E.
What Condo Owners Should Do Next?
If you own a condo in Costa Rica, now is the time to:
- Check your bylaws and make sure there is no prohibition for meetings to be held virtually.
- Confirm your contact info with your condo administrator to receive future meeting invites.
- Familiarize yourself with the virtual platform your condo plans to use.
