LOPDP clauses for telecom AI providers

Our partner Christian F. Espinosa-Velarde, head of the TMT, Privacy, Cybersecurity and Data Protection practice of ECIJA Ecuador, presents the article "LOPDP clauses for AI providers in telecom", in which he analyses the main contractual and compliance aspects when artificial intelligence providers process personal data on behalf of telecommunications operators.

The article addresses the main elements that must be incorporated in contracts when an AI solution provider acts as a processor of personal data, highlighting the importance of clearly establishing the purposes of the processing, the types of data used and the control mechanisms over the use of the information.

Likewise, the analysis explains the relevance of including clauses that prohibit the reuse of data for the training of the provider's own models, the creation of profiles for other purposes or the use of the information for products other than the contracted service, unless expressly authorised by the data controller.

It also analyses information security obligations, which must be proportionate to the risk and, above all, verifiable, including access controls, technical and organisational security measures, audits and data processing traceability mechanisms.
