Reform to the Federal Labour Law: Ley Silla (Chair Law)

 By Tania Ávila and Julio SilvaOn 19 December 2024, the Congress of the Union finally approved the reform to the Federal Labour Law ("LFT") called "Ley Silla" (the "Reform"), which strengthens the provisions to guarantee the well-being of workers who perform their activities standing up.   • Making available to working persons in the service, commerce and similar workplaces sectors, for the purpose of performing their activities or for rest, the appropriate number of seats or chairs with  This is also applicable to industrial establishments where the nature of the work permits.
  • It prohibits forcing workers to stand during their entire working day and prohibiting them from sitting for periods during their working day.
  • The internal work regulations must include guidelines for the use by workers of seats or chairs with backrests.

Transitional provisionsIt is also established that the Ministry of Labour and Social Security ("STPS") must issue the corresponding rules on occupational risk factors within 30 days after the entry into force of this Reform. On the other hand, employers are granted 180 days to adjust their internal regulations and ensure compliance with the new provisions of the Reform.
