"The Constitutional Chamber has ruled that the problem of the need to address the issue of sewage and water overflows is a shared responsibility," said Mariela Hernández, partner at Ecija Costa Rica, specialists in public law.
“Judicial practice allows us to appreciate that all of the aforementioned public entities could bear some responsibility, which is positive for guaranteeing the rights of the people they administer,” commented Alonso López, a specialist lawyer at Ecija.
"According to the principle of expediency, authorities would have a duty to act when the protection of life, health or safety is at risk. In such cases, the local government that knows of the risk must act in a diligent and timely manner," the experts agreed.
