EU Inc.: towards a genuine single market for start-ups, with fewer barriers and greater operational flexibility.

The European Commission has made a significant step forward with its proposal for the EU Inc. plan, a legal model designed to simplify the creation and expansion of start-ups in Europe through a single structure recognized across all Member States. Among its key innovations is the possibility of establishing a company in just 48 hours at a significantly reduced cost compared to current processes, which can take weeks and cost up to €25,000.


The initiative responds to a historic demand from the entrepreneurial ecosystem to eliminate regulatory fragmentation within the EU and facilitate access to finance and markets. In this regard, the new model will allow companies to operate more flexibly across different countries, attract international investment—particularly from US funds—and scale without the current regulatory friction.


Leticia Domínguez, partner at ECIJA, emphasizes that this proposal shares the same philosophy as Spain's Startups Law: reducing administrative barriers, promoting digitalization, and fostering the attraction of talent and investment. However, she highlights that the European approach goes a step further by allowing truly pan-European operations.


Domínguez also highlights one of the most transformative elements of the regime: the ability to create companies through a single European digital portal, which will represent “a decisive leap in agility and operational simplification.” This measure will allow start-ups to focus on their core business from the outset, avoiding the complexity of having to adapt simultaneously to 27 different regulatory systems.


In a context where Europe seeks to strengthen its global competitiveness and capacity for innovation, EU Inc. emerges as a key tool to boost entrepreneurship and consolidate a true single market.
