ECIJA Ecuador launches digital tools to strengthen compliance with the Personal Data Protection Law in Ecuador
In line with its commitment to legal innovation and the digital transformation of regulatory compliance, ECIJA GPA has developed and made available to the public two free interactive simulators designed to support organisations in the implementation of the Organic Law on Personal Data Protection (LOPDP).
These digital tools address two of the main challenges faced by companies in the current regulatory context:
- The mandatory appointment of the Data Protection Officer (DPO).
- The referential estimation of administrative sanctions for non-compliance with the regulations.
Tool 1: Data Protection Officer (DPO) Simulator
This simulator allows organisations to evaluate, in a referential manner, whether they are legally obliged to appoint a Data Protection Officer. The tool considers criteria established in Resolution SPDP-SPD-2025-0028-R, the LOPDP and its Regulations, thus facilitating the practical understanding of the current legal framework.
The platform allows you to explore the different cases of designation, identify the obligations according to economic activity and sector, and visualise the requirements set out in the regulations.
Tool 2: Penalty Simulator
This second tool consists of a reference calculator of sanctions that allows estimating the potential impact of an infringement to the LOPDP, based on technical criteria and parameters extracted from the current sanctioning regime.
The simulator takes into account factors such as the seriousness of the infringement, the nature of the personal data involved, the level of cooperation with the authority and other elements that will be evaluated by the Superintendence of Personal Data Protection at its discretion.
