Duty of information

Law no. 58/2019 of 8 August 2019, hereinafter "LPDP", and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter "GDPR"), guarantee the protection of natural persons with regard to the processing of personal data and the free movement of such data.

Personal data" means any information of any kind, whatever its nature and whatever its medium, including sound and image, relating to an identified or identifiable natural person, and therefore the protection does not extend to data of legal persons.

An identifiable person is one who can be identified directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity (for example, his name associated with his telephone number or e-mail address).

Categories of personal data

In accordance with the purposes mentioned below, we may process the following categories of personal data:

(a) Identification and contact data: first name, surname, e-mail address, address and telephone number;

b) Professional data: professional category, position, company in which you provide services and corporate contact details;

c) Academic and professional data: in cases where you send us your CV or are interested in participating in selection processes, data relating to training/qualifications, academic history, professional experience, membership of professional bodies or associations may be processed;

d) Data used for profiling: information relating to use of the website, subscription to newsletters, registration for events through the website, requests for contact or information about services, or participation in quality surveys;

e) Browsing data: IP address, advertising ID, user behaviour on the website;

f) Other data: any other data provided directly by the user in communications through the channels provided for this purpose.


Purposes of the processing of personal data

The personal data that we process through the aforementioned website will only be used for the following purposes:

a) To manage the contracting of services that you carry out through the Website, such as scheduling meetings and contact requests;

b) To periodically send our electronic bulletins - newsletters - with news related to AdCE's activity and the sector in which it operates;

c) Manage the candidature presented for a selection process, including the analysis of the Curriculum Vitae and the Letter of Application;

d) Periodically send commercial and/or promotional information related to the sector of the contracted services, unless the holder objects or withdraws his/her consent;

e) Anonymous and aggregated analysis of the use of the services, to identify user habits and trends, in order to improve the services offered and meet the specific needs of users;

f) In the event of recruitment, the data collected on this Website, together with the other data obtained within the framework of the contractual relationship, will be used for the management of human resources, to ensure compliance with legal obligations and to provide employees with the means necessary for the performance of their professional activity;

g) Compliance with national and international legal provisions or execution of an order of the competent judicial authorities;

h) Compliance with legal obligations, deriving from the applicable legislation on data protection, as well as for the exercise of the rights of data subjects, in particular, the defence of a right in legal proceedings.

AdCE guarantees the confidentiality of all data provided. However, although AdCE carries out the collection and processing of data in a secure manner, using the most appropriate techniques to prevent loss or manipulation, it is important to bear in mind that the collection of data on open networks allows the circulation of personal data without absolute security conditions, with the risk of it being seen and used by unauthorised third parties.

Failure to reply to the data marked as compulsory implies the impossibility to process the data subject's request.


Legitimacy for the processing of personal data

AdCE processes Users' data:

(i) when they express their express and free consent to the processing of their personal data for specific purposes and/or,

(ii) when it is necessary for the performance of a contract to which the data user is a party, or for the implementation of pre-contractual measures at the request of the user;

(iii) for the performance of legal obligations to which AdCE is subject;

(iv) for the purposes of the legitimate interests pursued by AdCE or by third parties, except where the interests or fundamental rights and freedoms of the owner prevail and require the protection of personal data.

The User guarantees that the information provided is true, accurate, complete and up to date, and is responsible for any direct or indirect damage or harm that may arise from failure to comply with this obligation.

In the event that the data provided belongs to a third party, the User guarantees that he/she has informed said third party of the aspects contained in this document and has obtained their authorisation to provide their data to AdCE for the purposes indicated.


Retention period

AdCE only retains and processes your personal data for the period that is necessary or obligatory to fulfil the purposes described above, applying information retention criteria appropriate to each processing and in accordance with the applicable legal and regulatory obligations.

AdCE keeps personal data in its systems in such a way that it is possible to identify the data subjects in accordance with the following criteria:

  • for a period of time no longer than is necessary to achieve the purposes for which they were collected, provided that legal or contractual obligations do not provide otherwise;
  • to fulfil specific legal or contractual obligations;
  • where applicable and legitimate, until an eventual request for objection or deletion by the Data Subject.


Communication of data

In addition to the communications made in compliance with legal obligations, the personal data of the Data Subject may be known, in addition to AdCE, by:

  • AdCE employees and collaborators, in their capacity as authorised data processors;
  • national and international companies belonging to the same group as AdCE;
  • authorities in general, administrations, entities and public bodies, both national and international;
  • external service providers.

Exclusively for the aforementioned purposes, in accordance with the consents granted by the Data Subject.


International data transfers

The personal data collected will be processed within the European Economic Area, with no international data transfers to third countries or international organisations.

In the event of any processing of personal data outside the European Economic Area, this will only take place with the adoption of appropriate safeguards and the required level of protection, in accordance with the legislation on the protection of personal data.


Information security

AdCE has implemented the appropriate technical and organisational security measures to guarantee the security of the personal data provided by the User, with the aim of avoiding its alteration, loss, processing and/or unauthorised access, taking into account the current state of technology, the nature of the data stored and the risks to which they are exposed.

Personal data are treated with the level of protection legally required to guarantee their security and avoid their alteration, loss, treatment or unauthorised access, taking into account the state of technology, the user being aware and accepting that security measures on the Internet are not impregnable.

Whenever it accesses personal data, AdCE undertakes to:

  • Store them by means of legally required security measures, of a technical and organisational nature, which guarantee their security, thus avoiding their alteration, loss, unauthorised processing or access, in accordance with the state of technology at any given time, the nature of the data and the possible risks to which they are exposed;
  • Use the data exclusively for the purposes previously defined;
  • Implement physical security measures for the protection of the premises;
  • Guarantee that the data are processed only by those collaborators whose intervention is necessary to meet the request of the data owner, who are bound by the duty of secrecy and confidentiality. In the event that the information must be disclosed to third parties for the aforementioned purposes, these shall be obliged to maintain due confidentiality in accordance with the provisions of this document.

In the event that AdCE subcontracts to other entities the provision of services that involve the transfer of personal data, these entities shall be obliged to adopt the necessary technical and organisational measures to protect personal data against destruction, loss, alteration, disclosure, unauthorised access or any other type of unlawful processing.
